Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Nod mobile application, the website at asknod.ai, the Nod CLI, and all related services (collectively, the “Service”) provided by Nod (“we”, “our”, or “us”).
By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and have the authority to enter into these Terms.
2. Account Registration
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
3. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable laws or regulations.
- Attempt to gain unauthorized access to the Service, other accounts, or related systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to transmit malicious code, spam, or harmful content.
- Reverse-engineer, decompile, or disassemble any part of the Service, except where permitted by the open-source license of the CLI.
- Use the Service to build a competing product or service.
4. Agent Connections and Data
The Service allows you to connect AI agents and agentic systems to the Nod platform. You are solely responsible for the behavior and output of your agents. We are not responsible for any actions taken by your agents, including but not limited to code execution, file modifications, API calls, or decisions made by autonomous systems connected through the Service.
You retain ownership of all content and data you transmit through the Service. By using the Service, you grant us a limited license to process, transmit, and store this data solely to provide the Service.
5. Open Source CLI
The Nod CLI is open-source software. Your use of the CLI is governed by its respective open-source license, which is separate from these Terms. These Terms govern your use of the Nod platform, API, and hosted services.
6. API Usage
Access to the Nod API is subject to rate limits and usage quotas. We reserve the right to throttle or suspend API access if usage patterns are abusive or threaten the stability of the Service. You must not share your agent secrets or API credentials with unauthorized parties.
7. Intellectual Property
The Service, including its design, features, and content (excluding user-generated content and the open-source CLI), is owned by Nod and protected by intellectual property laws. The Nod name, logo, and branding are our trademarks. You may not use them without our prior written consent.
8. Third-Party Services and AI Systems
Nod is a communication platform. It does not integrate with, connect to, or make calls to any third-party AI vendor or service. Nod does not host AI agents, run AI models, or process your data with any AI system.
You may choose to connect your own independently-operated systems (which may use AI services such as Claude, GPT, or others) to Nod via our public API. Any such connections are configured and controlled entirely by you. We are not responsible for the availability, accuracy, behavior, or practices of any external systems you connect. Your use of third-party AI services is subject to their respective terms and policies, not ours.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We disclaim all liability for actions taken by AI agents connected to the Service.
10. Limitation of Liability
To the maximum extent permitted by law, Nod shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Nod, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or the actions of agents you connect to the Service.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time through the app or by contacting us. Upon termination, your right to use the Service ceases immediately.
13. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Nod is incorporated, without regard to conflict of law principles.
